DOCKET NO. RSC-CV-812
DEFAULT JUDGEMENT AND ORDER
v.
PROCEED101.
MEMORANDUM JUDGEMENT AND ORDER
The defendant in the above matter appeared before the Court but did so in a way that was
obstreperous, disruptful and rude to the Court and the parties involved. Defendant stated he
would not submit a response to the complaint and continually claimed that the plaintiff was a
criminal (an unsubstantiated and unproven fact).
Defendant was further found in direct contempt of court and was issued a warrant for his
arrest, after making further threats to the court he was found in direct contempt of court and
another warrant for the maximum time was issued for his arrest. Rule 37(a) of the Civil Rules of
Procedure detail the prerequisites for a default judgement and with the Court finding an
adherence to these requirements a default order is issued in favour of the plaintiff.
THEREFORE, the Court hereby GRANTS the order for default judgement awarding the
full and maximum amount of $5,000 as prayed for by the plaintiff in their complaint. The
defendant has seven (7) days from the publication of this judgement to comply with the order or
a warrant shall be issued for their arrest.
