SUBJECT: Brief for Expedited Hearing under the Employee Desertion Act (In Re
BattalionTruckie)
On December 13th, 2022, the Military Intelligence Service received a complaint against Recruit
BattalionTruckie for being arrested for “Trespassing” while employed within the Ridgeway
National Guard as a recruit. The Recruit was placed under Administrative Leave and an
investigation began into the allegations of the arrest. On December 15th, 2022, the Military
Intelligence Service was informed that Recruit BattalionTruckie had left the Ridgeway National
Guard Discord server & Roblox group. The Investigator assigned to the case began their
investigation and when the recruit was contacted for a statement, they denied giving a statement
and informed the investigator that they did not wish to be a part of the investigation and wanted
the investigation to continue without their testimony. As a result, the investigation continued where
the investigator sustained the final disposition of the case and found Recruit BattalionTruckie in
violation of Code of Conduct 3002.1(r) - Desertion & 3003.1(f) - Conduct Prejudication to the
Government.
The Ridgeway National Guard’s Code of Conduct 3002.1(r) - Desertion states, “the act of
leaving official post without the proper authorization to do so or failing to follow all applicable
regulations while leaving post.” Recruit BattalionTruckie did not notify any command member of
them leaving their official post therefore in violation of such policy as they did not receive proper
authorization per the Code of Conduct. A Type I violation of the Code of Conduct can result in
dishonorable discharge from the department. During the investigation, the Department was able to
contact Recruit BattalionTruckie but they did not wish to comply with the investigation as seen in
Exhibits C & D of this brief. Therefore, the investigation continued without their testimony for all
allegations against them.
The Ridgeway National Guard now files this brief for waiver of hearing under the
Employee Desertion Act. Furthermore, the department demands termination from the Ridgeway
National Guard and dishonorable discharge.
