OF THE
HONOURABLE JUDGE KOALAMEDVEDEVA
I. Background
[1] The Criminal Information against the accused, a9ndy, was filed by the State of
Ridgeway on November 21, 2022.
[2] All the misdemeanour and felony offences charged in the Criminal Information
were alleged to have occurred on August 22, 2022—91 days before the Criminal
Information was filed.
[3] The Statute of Limitations Act provides in s. 3.1 that:
“No felony charges shall be filed, refiled, or investigated by the State if the act
which offended the State occurred ninety (90) days prior to the filing of a
Criminal Information or other forms of initiating a criminal proceeding.”
[4] The Statute of Limitations Act provides in s. 3.1 that:
“No misdemeanor charges shall be filed, refiled, or investigated by the State if
the act which offended the State occurred ninety (60) days prior to the filing of
a Criminal Information or other forms of initiating a criminal proceeding.”
[5] The accused now moves to dismiss the Criminal Information in its entirely.
II. Conclusion
[6] The limitation period of all misdemeanour offences charged had lapsed on
October 21, 2022.
[7] The limitation period of all felony offences charged had lapsed on November
20, 2022.
[8] Proper relief is terminating the proceedings initiated by an unlawfully filed
Criminal Information.
[9] The accused’s motion is granted and the Criminal Information is dismissed.
