he wasn't armed as his uzi sling wasn't present on my screen

he was brandishing his firearm in front of us as we attempted to secure and transport a subject and
therefore deemed him as a possible threat

That was then though, no? An imminent threat is a danger that would occur within an immediate
timeframe. Despite the fact that Pirate hadn’t even fully withdrawn his firearm in that clip, he would have
posed a threat then and there rather than a few minutes later at the Small Bridge, correct?

and you previously testified that you were unaware any of the occupants of the vehicle were armed

yeah that's before my video refreshed my mind

also about the threat thing. if you add up the fact that he 1. brandished his firearm in front of us whilst
attempting to transport. 2. chased us and attempted to desync us. 3. we are now stranded without a mode
of transport. 4. a bolo was placed on a car with the same description about 30 seconds before that clip for
firearm related reasons. 5. I am unsure if his lfa is still active. I would deem him to an extent an
immediate threat from the point we were stranded.

be noted pirate was only a passenger
And there were two cars of the same model, same color
And as for the lfa, he was calm and able to be apprehended. If there was uncertainty, he could’ve been
tased and cuffed, yes?
Gavin took a pause after shooting him, in that time he could’ve easily withdrawn and discharged his
firearm.
No fugitive from the law will go in front of SRT operatives for laughs and giggles then not do anything.

in that moment in time i would've classed pirate as a potential immediate threat
and hypothetically, yes gavin could've attempted to cuff or tase pirate
but in that situation and if i was gavin and i knew for surepirate was lfa, which he said he did i can't say i
wouldn't have done the same thing gavin did

I believe voluntary manslaughter would be more applicable, the defendant was clearly in distress and
called for backup believing that the civilian was hostile and had the intent to harm the officer, however he
did act way way too quick as the civilian was just standing there and it doesn't seem like they were trying
to flee either.
