Exhibit B is a set of written statements given during an interview out of court. In
general, evidence of this nature—a taped, written or oral interview where the
interviewee-declarant gives statements out of court—is inferior, hearsay evidence. And
in general, the probative value of evidence of this nature is substantially outweighed by
the prejudicial effect that results from the tendency of evidence of this nature to draw
legal conclusions: State of Ridgeway v. InfinityTurtleXD, RSC-CM-350 (2022). Exhibit
B is hearsay and not saved by its probative value. It is admissible except for the purpose
of proving the truth of the content of the statements.
Exhibit C is a Civil Complaint filed in the Superior Court. Exhibit C is admissible to
the extent that it is not hearsay.
