Good Evening Grand Jurors, thank you all for being here. As requested,
I'm going to walk you through the charges that I felt were suitable
for the actions of the defendant on the 18th of June, of this year
2022. We are going to start off with Exhibit B, we can see a Ridgeway
State Police Trooper in pursuit of a pickup truck, going through
Sterling Heights, at this point passing the Sheriff’s Office
substation onto the Highway. The Defendant is at extraordinarily high
speeds, which can be demonstrated by the Trooper doing over 110 Studs
Per Seconds to try and keep up with the Defendant. As the Defendant
makes progress on to the highway, we see the Defendant blow the red
light at extremely high speeds, and he begins to swerve from lane to
lane on the highway, we see this all the way up until the Defendant’s
vehicle is stopped by the Trooper and Deputy - who had joined the
pursuit, as shown in Exhibit E. At the timestamp 00:32 in Exhibit B,
we finally see the Defendant’s vehicle at a stop. The Trooper quickly
gets out of his vehicle, similarly to the Deputy and the Defendant, as
the Trooper attempts to taser the Defendant, the Defendant pulls out a
Cline 911 - a Silver handgun chambered in 9 Millimeter rounds. The
Defendant begins to fire at the Trooper in an attempt to kill him,

which sadly he does, the Trooper is shot and killed by the Defendant.
Following the Trooper’s murder, the Defendant turns the gun to the
Deputy, firing at him and subsequently murdering him. In Exhibit B,
you can clearly see that the Trooper and Deputy were clearly marked as
Law Enforcement Officers, in their uniforms, and to top it off, we see
both vehicles are clearly marked patrol cars. This accounts for the
first two counts on the indictment. Murder in the First Degree. For
the State to prove that this occurred, it merely requires us to prove
that the Defendant murdered a peace officer, discharing his lawful
duties, whilst the Defendant had the knowledge of the peace officer’s
role.
Let’s break it down. Was the Peace Officer discharging his lawful
duties? Yes, we see the Trooper & the Deputy enforcing the law,
pursuing someone who had broken the law. Would it be reasonable to
assume the Defendant knew that they were Peace Officers? Yes,
absolutely, they were in marked patrol cars, and both had the most
notable uniforms on, their patrol uniforms. As such, we can
confidently say that the Defendant committed Murder in the First
Degree twice.
Moving on, if we look at Exhibit F, from timestamp 00:40, we see the
Trooper respawn, kit back up, with his Trooper’s uniform, campaign hat
and duty belt. We see the Trooper respawn his vehicle, and immediately
respond back to the location of where he was murdered by the
Defendant. Upon arrival we see the Defendant. The Trooper jumps out of
his vehicle, again with his taser he attempts to taser and arrest the
Defendant, however he fails to do so, as the Defendant once again
pulls out his Cline 911 and begins firing. The Trooper pulls out his
Para 17, and immediately begins to fire at the Defendant, the Trooper
kills the Defendant. The State believes that a charge of Attempted
Murder is suitable, we can see in Exhibit F , that the Defendant
attempted to kill the Trooper, although he was unsuccessful. We can
see that the Defendant had the intent to do so, because upon the
Trooper exiting his vehicle, and drawing a taser, the Defendant begins
to fire immediately. As such, we can confidently say that the
Defendant attempted to murder the Trooper.
Finally, we look at Exhibits B, D, E & F. We can see the Defendant
evading from the Trooper and Deputy in a reckless and utterly
negligent way. We witness the Defendant running stop signs, driving

off road, cutting corners, running red lights and speeding in excess
of 100 studs per seconds at most times. What does the State have to
prove for a charge of Felony Evasion? The State must prove that the
Defendant was evading and create a danger to the public through the
negligent use of a firearm or recklessly driving. The State can do
this, the State merely can use the definition of Reckless driving as
‘committing more than 3 traffic violations in the space of 60 seconds
or driving off road in city limits’. We can see the Defendant commit
more than 3 traffic violations in the space of 60 seconds and we most
certainly saw the Defendant driving off road in city limits - whether
he intended to or not.
That is the summary of our charges, we believe that these charges are
sufficient for the Defendant’s actions on the 18th of June 2022. As
such, we hope that you return a true bill of indictment, formally
charging the Defendant with 2 Counts of Murder in the First Degree, 1
Count of Attempted Murder & 1 Count of Felony Evasion. Thank you.
