PLAINTIFF’S SECOND SET OF REQUESTS FOR ADMISSION
Plaintiff chexburger, by and through undersigned counsel, hereby serves
Defendant BattalionGavin these requests for admission.
You shall verify the answer to the requests for admission in some matter
permitted by law, separately and fully in writing, seven (7) business days after
service of these requests. You are further obligated to supplement these answers
not less than seven (7) business days before the beginning of the trial in this matter
if you later obtain information that will change your answer.
DEFINITIONS
Notwithstanding the specific definitions below, each word, term, or phrase
used in these requests should be given their most expansive and inclusive meaning.
As used in these requests, the following terms are to be interpreted in accordance
with these definitions–
“You” means the person or entity served with these requests.
“And” and “or” are to be construed both conjunctively and disjunctively as
necessary to give each request its broadest possible meaning.
"Each", "any", and "all" mean each and every.
“Relating to,” “relate to,” “related to,” and “relates to” means in any way
concerning, containing, describing, constituting, referring to, evidencing,
mentioning, reflecting, identifying, refuting, contradicting, supporting, connected
with or in any way about the subject, in whole or in part.

"Including" means including, but not limited to.
"Person" means any natural person, corporation, company, partnership, joint
venture, firm, association, proprietorship, agency, board, authority, commission,
office, or other business or legal entity, private or governmental.
The phrase "describe in detail" is a request for a complete description and
explanation of the facts, circumstances, analysis, opinion, and other information
relating to the subject matter of a specific request.
"Identify" or "identity" means to state or a statement of–
a. In the case of a person other than a natural person, its name, the address of
its principal place of business, its telephone number, and the name of its
chief executive officer, as well as, if it has a person other than a natural
person that ultimately controls it, that other person's name, the address of
that person's principal place of business, that other person's telephone
number, and the name of that other person's chief executive officer;
b. In a natural person's case, name, business address and telephone number,
employer, and title or position;
c. In the case of a communication, its date, type (e.g., telephone conversation
or discussion), the place where it occurred, the identity of the person who
made the communication, the identity of the person who received the
communication, the identity of each other person when it was made, and the
subject matter discussed;
d. In the case of a document, the title of the document, the author, the title or
position of the author, the addressee, each recipient, the type of document,
the subject matter, the date of preparation, and its number of pages; and
e. In the case of an agreement, its date, the place where it occurred, the identity
of all persons who were parties to the agreement, the identity of each person

who has knowledge of the agreement, and all other persons present when it
was made, and the subject matter of the agreement.
"Defendant", or "you" refers to the party or parties being served with these
requests.
“Anyone acting on your behalf” means all persons including your agents,
employees, insurance companies, attorneys, investigators, or consultants.
"Agreement" means a contract, arrangement, or understanding, formal or
informal, oral or written, between two or more persons.
"Communication" means any disclosure, transfer, or exchange of
information or opinion, however made.
“Complaint” refers to each and every complaint, case, suit, or investigation
whether or not it was formal, informal, civil, criminal, filed in a court of law,
settled, or dismissed. If no docket number or case citation is provided, a reference
to the "Complaint" is to the Complaint filed in this matter.
“Document” or “documents” includes any writing or other medium,
including, but not limited to, electronic, magnetic, or optical media, by which
information is transmitted or recorded. The terms also include all drafts,
amendments, modifications, changes or side correspondence, notes, or
non-identical copies such as those that include marginalia or other printed,
stamped, or handwritten revisions or notations.
“Government” means the federal government, a state government, a
government of a city, county, or other municipality, or the government of a foreign
country. The term government also includes any agencies, branches, agents, or
representatives of a government.
“License” means any certification provided by an agency, government, or
other certifying body.

“Requests” refers to this document, and each and every request contained
within this document.
The singular form of a noun or pronoun shall be considered to include within
its meaning the plural form of the noun or pronoun, and vice versa, and the past
tense shall include the present tense where the clear meaning is not distorted. The
term "or" shall mean "and" and vice-versa, as is necessary to bring within the scope
of the following requests all information or documents that would be excluded
absent this definition.
INSTRUCTIONS
Where knowledge, information, or documents are requested, such request
encompasses knowledge, information, or documents in the possession, custody, or
control of either you, your staff, agents, employees, representatives, and, unless
privileged, attorneys or any other person who has possession, custody or control of
your proprietary knowledge, information or documents.
To the extent that you believe any request is ambiguous, your answer should
set forth the matter deemed ambiguous and the construction used in responding.
These requests are continuing in nature and must be supplemented promptly
if you obtain additional or different information related to any response at any time
before the termination of this action.
For any request or part of a request which you refuse to answer under a
claim of privilege, submit some type of verified statement from you or your
counsel in which you identify the nature of the information withheld; specify the
grounds of the claimed privilege and the paragraph of these requests to which the
information is responsive; and identify each person to whom the information, or
any part thereof, has been disclosed.
Answer each request fully. If you object to any request, state the reasons for
objection and answer to the extent the request is not objectionable. If you are

unable to answer a request fully, submit as much information as is available,
explain why your answer is incomplete, and identify or describe all other sources
for more complete or accurate information.
For any record or document responsive or relating to these requests which
are known to have been destroyed or lost, or is otherwise unavailable, identify each
such document by author, addressee, date, number of pages, and subject matter;
and explain in detail the events leading to the destruction or loss, or the reason for
the unavailability of such document.
REQUESTS FOR ADMISSION
1. Admit that you struck chexburger’s vehicle, whether intentionally or
unintentionally;
2. Admit that chexburger did not intentionally strike any vehicle in the
Sheriff’s Office parking lot;
3. Admit that the vehicles parked in the Sheriff’s Office parking lot were
illegally parked;
4. Admit that the vehicles parked in the Sheriff’s Office parking lot were
parked in a manner that obstructs traffic;
5. Admit that the vehicles parked in the Sheriff’s Office parking lot were
parked in a discourteous manner;
6. Admit that the first strike at 0:27 in Exhibit A was unintentional and thus
cannot be considered a strike;
7. Admit that the second strike at 0:46 in Exhibit A was unintentional and thus
cannot be considered a strike;
8. Admit that the third strike at 1:04 in Exhibit A was unintentional and thus
cannot be considered a strike;
9. Admit that the fourth strike at 1:14 in Exhibit A was unintentional and thus
cannot be considered a strike;

10. Admit that the fifth strike at 1:33 in Exhibit A was unintentional and thus
cannot be considered a strike;
11. Admit that the sixth strike at 1:36 in Exhibit A was caused by the green
truck and not chexburger;
12. Admit that the green truck intentionally crashed into chexburger and made
his purple Tremor spin around in the opposite direction;
13. Admit that when chexburger drove, the green truck recklessly attempted to
crash into chexburger;
14. Admit that you attempted to chase the green truck;
15. Admit that when chexburger evaded the green truck’s path, you crashed into
chexburger either intentionally or unintentionally;
16. Admit that chexburger did not commit reckless driving;
17. Admit that chexburger did not intentionally or knowingly commit three (3)
or more traffic offenses within one minute;
18. Admit that chexburger did not intentionally or knowingly strike any other
vehicle;
19. Admit that reckless driving (Rid. Veh. Code § 7.02)1 is not a strict liability
offense;
20. Admit that reckless driving (Rid. Veh. Code § 7.02) requires intent to
commit;
21. Admit that your arrest of chexburger was within your discretion and you
abused your discretion;
22. Admit that you have a personal grudge against chexburger;
23. Admit that as a result of that personal grudge, you arrested chexburger;

24. Admit that an action was commenced against you by Mxrlsx on or about
August 25th, 2022 for allegedly falsely arresting them for aggravated assault;
25. Admit that you received training by the Law Enforcement Training Center
(LETC) and you gained certification to be a law enforcement officer (LEO) from
LETC in this State;
26. Admit that you are overly aggressive in conducting your law enforcement
duties;
27. Admit that you are potentially narcissistic in conducting your law
enforcement duties;
28. Admit that a vast portion of the public dislikes you;
29. Admit that you petitioned for expungement on or about August 25th, 2022;
30. Admit that such petition was denied;
31. Admit that you have no knowledge of the laws of this State;
32. Admit that you have no knowledge of the Ridgeway Rules of Civil
Procedure;
33. Admit that you received training on the laws of this State by LETC;
34. Admit that you forgot such training;
35. Admit that you have been subject to discipline in any way, shape, or form by
any government entity (including but not limited to the Ridgeway County Sheriff’s
Office or LETC);
36. Admit that you are very rude to people;
