SUMMONS IN A CIVIL ACTION
THIS SUMMONS IS DIRECTED TO BATTALIONGAVIN
A civil action has been brought forth against you. The Plaintiff(s) named above has started a lawsuit
against you. A copy of the Plaintiff’s Complaint filed against you is provided in the service of this summons
and the original complaint has been filed in the Superior Court of the State of Ridgeway. You must act
promptly to protect your rights.
Within five (5) days after service of this summons on you (not counting the day you received it) — or
seven (7) days if you are the State of Ridgeway, the County of Ridgeway, a municipality, or an agency thereof
as described in Rid. R. Civ. P. 4 (d)(2) — you must appear before the court communications program and file a
motion or answer to the complaint before the aforementioned. If you need time to respond, you may request
an extension of time in writing from the Court.
An answer is a way in which you may respond to the attached Complaint. Your answer must state
whether you agree or disagree with the fact(s) alleged in each paragraph of the Complaint. Some defenses,
called affirmative defenses, must be stated in your answer or you may lose your right to use them in court. If
you have any claims against the Plaintiff (referred to as counterclaims) that are based on the same facts
described in the Complaint, then you must include those claims in your answer. Otherwise, you may lose your
right to sue the Plaintiff about anything related to the lawsuit.
You may also respond to the Complaint by filing a “Motion to Dismiss”, if you believe that the
complaint is legally invalid or legally insufficient. A Motion to Dismiss must be based on one of the legal
deficiencies or reasons listed under Rid R. Civ. P. 12.
You may wish to get legal assistance from an attorney. If you are unable to obtain legal assistance, you
may request referral to an attorney by the Ridgeway State Bar and appointment of counsel by the court.
If you fail to respond, judgment by default will be entered against you for the relief demanded in the
complaint.

COMPLAINT
chexburger, by and through undersigned counsel, hereby brings this civil
action and alleges that–
INTRODUCTION
1. On or about Saturday, August 20th, 2022, Plaintiff chexburger (hereinafter
“Bark”) was taking his purple Tremor out for a joyride in the parking lot of the
Headquarters of the Ridgeway County Sheriff’s Office.
2. After a minute or so of joyriding, a green Lancaster truck joined and circled
the parking lot along with Bark. Then, the parked undercover vehicle operated by
Defendant BattalionGavin hit Bark’s vehicle and placed him under arrest for
reckless driving.
JURISDICTION AND VENUE
3. This Court has jurisdiction pursuant to Article V, Section IV of the
Constitution of the State of Ridgeway.
4. Venue is proper in this Court because the incident took place within
Ridgeway County.
PARTIES
5. Plaintiff chexburger is a resident of the State of Ridgeway.
6. Defendant BattalionGavin is a Deputy of the Ridgeway County Sheriff’s
Office and is sued in his official and individual capacity.

FIRST CAUSE OF ACTION
(False Imprisonment)
7. Plaintiff repeats and realleges the allegations contained in all preceding
paragraphs as if fully set forth herein.
8. Gavin falsely arrested Bark for reckless driving. Reckless driving is—
“The act of operating a motor vehicle and committing 3 or more traffic
infractions within 60 seconds, driving offroad while within city limits, or
striking other vehicles.”
R.V.C. § 7.02. Seeing as Gavin struck Bark and not the other way around,
Gavin falsely arrested and imprisoned Bark.
SECOND CAUSE OF ACTION
(Battery)
9. Plaintiff repeats and realleges the allegations contained in all preceding
paragraphs as if fully set forth herein.
10. Gavin brought unconsented harmful and/or offensive contact against Bark
by striking his vehicle.
PRAYER FOR RELIEF
Wherefore, Plaintiff(s) pray(s) that the Court–
ON THE FIRST CAUSE OF ACTION
a. Declare that Defendant’s arrest of Plaintiff on or about August 20th, 2022,
was unlawful;
b. Order the arrest expunged from Plaintiff’s criminal record;
c. Award Plaintiff actual and punitive damages;
d. Order Defendant to apologize for their conduct;
e. Award Plaintiff attorneys’ fees;
f. Award such other, further, or different relief as may be just and proper.
