PLEASE TAKE NOTICE that a proceeding to perpetuate testimony has
been commenced against you, and a copy of the petition is attached hereto. You
must act promptly to protect your rights.
Within five (5) days after service of this notice on you (not counting the day
you received it) — or seven (7) days if you are the State of Ridgeway, the County
of Ridgeway, a municipality, or an agency thereof as described in Rid. R. Civ. P. 4
(d)(2) — you must appear before the court communications program. If you need
time to respond, you may request an extension of time in writing from the
Court.
You may wish to get legal assistance from an attorney. If you are unable to
obtain legal assistance, you may request to be appointed counsel by the Court.

VERIFIED PETITION TO PERPETUATE TESTIMONY
CardinalMonterruh, by and through undersigned counsel, hereby, pursuant to
Ridgeway Rule of Civil Procedure 20(a) and 1 R.S. § 207, respectfully petitions
this Court to perpetuate the testimony of CardinalMonterruh, domleisok, and
domieisok, and submits that–
THE INCIDENT
1. On August 7th, 2022, Petitioner CardinalMonterruh was in a faded red
Actilla (Charger) and ran a stop sign at the intersection of Belgrade Road and Dana
Street.
2. Respondent domleisok, in his official capacity as a Trooper of the State
Police, pulled over Cardinal for failure to yield to a traffic control device under
Rid. Veh. Code § 7.06, stating “for deleting my messages over a day, this is what
[you] are getting.” See Ex. A.
3. In order to generate probable cause for the stop, Domle purposefully stalked
Cardinal’s house and rented Cardinal’s house at 1500 Belgrade Road (the house
was owned by Cardinal but rent elapsed).
INFORMATION ABOUT THE EXPECTED ACTION
4. Cardinal intends to commence a civil action against Domle for official
misconduct (1 R.S. § 314) because his conduct violates the prescribed State Police
ethics policy, which states in relevant part–

“The following are illustrative of causes for administrative action, yet it is
not intended to cover all possible types of misconduct and it does not
preclude the recommendation of administrative action for violation of other
rules, standards, ethics, and specific action or inaction that is detrimental to
the efficient public service provided by the Ridgeway State Police–
…
The wrongful or unlawful exercise of authority on the part of any employee
for [a] malicious purpose, personal gain, willful deceit, or any other
improper purpose.”
State Police Dept. Policy Guide § 301-5.2(b) (Ex. C).
5. Domle’s conduct also violates the prescribed State Police conduct policy,
which states in relevant part–
“Any other on or off-duty conduct which any employee knows or reasonably
should know is unbecoming of an employee of the department, is contrary to
good order, efficiency or morale, or tends to reflect unfavorably upon this
department or its employees.”

FACTS TO PERPETUATE
Cardinal intends to perpetuate the following facts–
6. That domleisok threatened to find a reason to cite Cardinal for a traffic or
criminal offense based on a personal vendetta;

7. That domleisok purposefully stalked Cardinal’s house and when the rent
elapsed on the house, Domle rented the house to tempt Cardinal to be at his house
and then while driving away, pull him over;
8. Any and all other facts that may come as a result of the testimony of
Petitioner and/or Respondents.
JURISDICTION AND VENUE
9. This Court has jurisdiction pursuant to Article V, Section IV of the
Constitution of the State of Ridgeway, Ridgeway Rule of Civil Procedure 20(a),
and 1 R.S. § 207.
10. Venue is proper in this Court because Respondents reside within Ridgeway
County, and the incident leading to this petition occurred within Ridgeway County.
PARTIES
11. Petitioner CardinalMonterruh is a resident of the State of Ridgeway.
12. Respondent domleisok is a resident of the State of Ridgeway and is a
Trooper of the Ridgeway State Police. He is named as a Respondent in his
individual and official capacity.
13. Respondent domieisok is a resident of the State of Ridgeway and is a Ranger
of the Ridgeway Park Service. He is named as a Respondent in his individual and
official capacity.
PRAYER FOR RELIEF
Wherefore, Petitioner prays that the Court allow him to perpetuate his own
testimony, and the testimony of Respondents for use in the expected action, and to
award such other, further, or different relief as may be just and proper.

STANDARDS OF CONDUCT
301-5.6 PERFORMANCE
A. Failure to disclose or misrepresenting material facts, or making any false or misleading
statement on any application, examination form, or other official document, report or form, or
during the course of any work-related investigation.
B. The falsification of any work-related records, making misleading entries or statements with
the intent to deceive or the willful and authorized removal, alteration, destruction and/or
mutilation of any department records or documents.
C. Failure to participate in, or giving false or misleading statements, or misrepresenting or
omitting material information to a supervisor or other person in a position of authority in
connection to any investigation or in the reporting of any department-related affairs.
D. Being untruthful or knowingly making false, misleading or malicious statements that are
reasonably calculated to harm the reputation, authority or official standing of the Ridgeway
State Police or its employees.
E. Disparaging remarks or conduct concerning duly constituted authority to the extent that
such conduct disrupts the efficiency of the department or subverts the good order, efficiency
and discipline of the department or that would tend to discredit any of its employees.
F. Solicitations, speeches or distribution of campaign literature for or against any political
candidate or position while on-duty or, on government property except as expressly
authorized by the government authority concerning the property.
G. Engaging in political activities while on-duty, except as expressly authorized by state
statutes, or the Colonel.
H. Any act on-duty or off-duty which brings discredit to the department.
301-5.7 CONDUCT
A. Failure of any employee to prompt and fully report activities on their part or the part of any
other employee where such activities resulted in contact with any other law enforcement
agency or that may result in criminal prosecution or in administrative action under this policy.
B. Unreasonable and unwarranted force to a person encountered or a person under arrest.
C. Exceeding lawful peace officer powers by unreasonable, unlawful or excessive conduct.
D. Unauthorized or unlawful fighting, threatening or attempting to inflict unlawful bodily harm
on another.
E. Engaging in antics which reasonably could result in injury or property damage.
F. Discourteous, disrespectful or discriminatory treatment of any member of the public or any
employee of the government.
G. Criminal, dishonest, or disgraceful conduct, whether on or off-duty, that adversely affects the
employee’s relationship with the department.
H. Unauthorized possession of, loss of, or damage of department property or the property of
others, or endangering it through carelessness or maliciousness.
I. Attempted theft or otherwise actual theft of department property; unauthorized removal or
possession of department property or the property of another person.
J. Activity which is incompatible with an employee’s conditions of employment or appointment
as established by law.
K. Any other on or off-duty conduct which any employee knows or reasonably should know is
unbecoming of an employee of the department, is contrary to good order, efficiency or
morale, or tends to reflect unfavorably upon this department or its employees.

STANDARDS OF CONDUCT
301-5.2 ETHICS
A. Employing or disclosing one’s status as an employee of the Ridgeway State Police in any way
that could reasonably be perceived as an attempt to gain influence or authority, excluding
matters of employment resumes.
B. The wrongful or unlawful exercise of authority on the part of any employee for malicious
purpose, personal gain, willful deceit or any other improper purpose.
C. The receipt or acceptance of a reward, fee or gift from any person for service incident to the
performance of the employee’s duties.
D. Acceptance of fees, gifts, or money contrary to the policies of the Ridgeway State Police
and/or applicable statutes.
E. Offer or acceptance of a bribe or gratuity.
F. Misappropriation or misuse of public property, personnel or services.
G. Any other failure to abide by the standards of ethical conduct.
301-5.3 DISCRIMINATION
Discriminating against, oppressing or providing favoritism to any person as aresult of age, race, color,
religion, sex, sexual orientation, or other protected classification under law, or intentionally denying
or impeding another in the exercise of enjoyment of any right, privilege, power or immunity as a
result, is considering a violation of policy.
301-5.4 UNAUTHORIZED ACCESS, DISCLOSURE OR USE
A. Unauthorized and inappropriate intentional release of confidential or protected information,
materials, data, forms or reports obtained as a result of the employee’s position in the
department.
B. Disclosing to any unauthorized person any active investigation information.
C. The use of any information, photograph, video or other recording obtained or accessed as a
result of employment or appointment to the Ridgeway State Police for personal or financial
gain or without the express authorization of the Colonel or their designee(s).
301-5.5 EFFICIENCY
A. Neglect of duty.
B. Unsatisfactory work performance including, but not limited to, failure, incompetence,
inefficiency or delay in performing and/or carrying out proper orders, work assignments or
the instructions of supervisors without a reasonable and bona fide excuse.
