BACKGROUND
On August 7, 2022, the state filed an information against the defendant alleging violations of 3 R.S.C §
09 and 5 R.S.C § 5. The defendant failed to appear; a not guilty plea was entered on their behalf. A mistrial was
declared due to ineffective assistance of counsel on the part of DavidLClarke. The retrial was completed on
November 3rd.
The government admitted one exhibit as a part of their case in chief exhibit A. This exhibit depicts the
Defendant’s alleged crimes. The State called two witnesses, Nice_guy1234567891, a witness to the events in
question and DetectiveHurtz, the recorder of the government’s exhibit A. .
JUDGMENT
The government successfully authenticated their exhibit A through the testimony of their two witnesses.
Although some of the testimony given by the government’s witnesses was weak, this court is satisfied that
neither witness was unqualified or unable to provide accurate and reliable testimony about the events in
question. Absent any objection from the defense to the exhibit or any glaring insufficiencies, this court must
accept the exhibit and events depicted in it as true.
The defense contends that it is difficult to make out the name of the assailant in the exhibit. This is true.
However, it is not impossible; there are several frames in which different parts of the defendant’s name can be
clearly seen. These parts can be put together to positively identify the defendant. In sum, the government has
demonstrated that it is possible to construct the name of the assailant in the incident based on the evidence they
have admitted.
Once we accept the authenticity of the evidence as well as the identity of the persons within it, we must
examine the acts committed by the person alleged to have perpetrated the charged crimes. At roughly 26
seconds into the government’s exhibit A, we can see the person identified as the defendant discharge their
firearm with intent and within the Palmer city limits without legal justification. This person, Deputy
Nice_guy1234567891, was engaged in their lawful duties as a peace officer and was clearly identifiable as a
peace officer based off of their username color as well as the badge located on their hip. The shots discharged at
the Deputy were fatal and they died at the time of the incident.
CONCLUSION
For the foregoing reasons, this court finds the Defendant:
- GUILTY ON COUNT ONE OF THE INFORMATION - 3 R.C.C § 9 - FIRST-DEGREE
MURDER
- GUILTY ON COUNT TWO OF THE INFORMATION - 5 R.C.C § 05 - UNLAWFUL
DISCHARGE OF A FIREARM
SO ORDERED, ADJUDGED AND DECREED.
