MOTION FOR DEFAULT JUDGEMENT
Plaintiff in the above named matter moves for default judgement in his favor. Defendants
have “five days…to file [any pleadings]” after sumons. Rid. R. Civ. P. 5(e). Defendant was
summoned on August 3, 2022 at 12:39pm EST. It is now August 9, 2022. Defendant has been
reminded a number of times in the case chat to file their answer. Defendant has failed to file any
answer to the complaint or plead their defense.
When a party has “failed to plead” this court shall “enter his default.” Rid. R. Civ. P. 37.
Defendant has failed to file any pleadings or defend themselves within the time period allowed.
Plaintiff respectfully asks for a default judgement in favor of the Plaintiff consistent with the
relief sought in our complaint. Accordingly, an affidavit will be filed to affirm the calculation of
attorney and filing fees associated with this case.
In accordance with 1 R. Stat. § 314, all damages shall be paid by the Defendant’s
individual capacity.
