MEMORANDUM FOR INTERNAL USE FROM: d_reamliy Employee Delinquency Officer SUBJECT: Brief for Waiver of Hearing RSC-AH-585; RSC-AH-586; RSC-AH-587 The Ridgeway County Sheriff’s Office is a public employer who has a particular interest in retaining all department property and equipment that is afforded to each employee in the course of their duties. At the beginning of each employee’s start at the department, the employee must agree to all contractual obligations stipulated in the employee handbook. One of these includes a privacy agreement that allows the department to search all persons, vehicles, and houses that are owned by the employee if there is a reason. The same agreement stipulates that the failure to abide by these requirements may result in termination of employment, which is codified and specifically outlined as an offense of dishonorable discharge into RCSO Pun. Code §4.09 [“Intentional Refusal to Abide by Contractual Obligation”]. On July 26th, 2022, an announcement was made tagging Employees NateLMarshall, Megamatt4545, and vincefant letting them know about their final tool collection notice. The announcement stated that the employees would have a window to get their tool collection done. The window would close July 27th, 2022 @ 11:59 PM EST. The employees did not respond to their final notice so they were given a notice stating the department will begin an Administrative Court Review and allowing them one last chance to conduct their tool collection and end of service search although the employees have failed to acknowledge the notice. It is now August 1st, 2022 and the employees have still failed to acknowledge the notice and have failed to contact us for tool collection, and end of service search. Therefore, the agency now files this brief to waive administrative hearing under the powers afforded to the Court under the Employee Desertion Act (Pub. L. 01-28).
