No. RSC-CV-580 COMPLAINT GeneralAtomicz and PoweringIm_gination, by and through undersigned counsel, hereby bring this civil action and allege as follows– INTRODUCTION 1. On or about July 30th, 2022, Plaintiffs GeneralAtomicz and PoweringIm_gination we’re in a crowd of people at the Palmer Car Dealership. 2. Out of nowhere, Defendant Andrew Kapalot with an unknown individual driving arrived in a Ridgeway County Transit Authority (RCTA) pickup truck. 3. Kapalot exited the truck and pointed an assault rifle at the crowd, including General and Powering, ordering the “white men” to “put their hands up”. JURISDICTION AND VENUE 4. This Court has jurisdiction pursuant to Article V, Section IV of the Constitution of the State of Ridgeway. 5. Venue is proper in this Court because the incident took place within Ridgeway County. PARTIES 6. Plaintiff GeneralAtomicz is a resident of the State of Ridgeway and resides at ADDRESS. 7. Plaintiff PoweringIm_gination is a resident of the State of Ridgeway and resides at ADDRESS. They are sued in their individual capacity. CAUSE OF ACTION (Assault) 9. Plaintiffs repeat and reallege the allegations contained in all preceding paragraphs as if fully set forth herein. 10. Defendant intentionally and voluntarily caused Plaintiffs reasonable apprehension of an immediate harmful or offensive contact when Defendant pointed an assault rifle at them and other people in the crowd. PRAYER FOR RELIEF Wherefore, Plaintiffs pray that the Court– a. Declare that Defendant assaulted Plaintiffs; b. Award actual and punitive damages; c. Order Defendant to apologize for their conduct; d. Award such other, further, or different relief as may be just and proper. Respectfully submitted.
