charge the defendant;
COUNT ONE - 3 S.C.C § 3 - ASSAULT WITH A DEADLY WEAPON
OFFENSE TYPE - FELONY

In Exhibit A, Defendant GregFerrero maliciously assaulted Hitherwguys with an axe by striking him
numerous times, an object which can cause severe harm or even death to a person.
COUNT TWO - 3 S.C.C § 8 - ATTEMPTED MURDER
OFFENSE TYPE - FELONY
MAX SENTENCE - 25 MINUTES
In Exhibit A, Defendant GregFerrero attempted to murder Hitherwguys by striking them numerous times
with an axe and then proceeding to chase Hitherwguys, causing severe bodily injury to Hitherwguys
before he was ultimately killed in self-defense.
STATEMENT OF PROBABLE CAUSE
I am Senior Detective ConstantlyVerbal, Criminal Investigations Division. I’ve been a law enforcement
officer for over 10 months in Ridgeway. I have been employed within the Ridgeway County Sheriff’s
Office since August 10th, 2021. I have been working within the Criminal Investigations Division since
October 8th, 2021 as a Detective. I am a certified peace officer by the Law Enforcement Training
Center. Based on personal knowledge and evidence provided to the Criminal Investigations Division, I
have probable cause to believe the following:
On June 11th, 2022, at or around 9:38 PM CST, Defendant GregFerrero alongside another individual
entered the Sterling Gun Club and walked towards the indoor shooting range. Greg, exhibiting an axe,
proceeded to enter the indoor shooting range where Mr. Hitherwguys was legally discharging their
firearm at the shooting targets. Upon entering the range, GregFerrero proceeded to hit Hither with an axe
multiple times. As Mr. Hitherwguys ran out of the shooting range, discharging their firearm, they headed
for the exit of the Gun Club, continuing to discharge their firearm at Defendant GregFerrero. As Mr.
Hither exited the Gun Club, Defendant Greg was able to strike Mr. Hither once more with the axe,
lowering their health and causing serious bodily injury. Mr. Hither was able to successfully run across
the street where he discharged his firearm again and promptly killed Defendant Greg in self-defense.
Shortly after, another individual appeared at the scene behind a truck with a shotgun and killed Mr.
Highterwguys who were defending themselves against Defendant Greg and another individual who
assaulted him.
It is clear that Defendant GregFerrero was attempting to kill Mr. Hitherwguys because he repeatedly
struck Mr. Hither numerous times causing bodily injury and even chased him outside the building before
he died. An axe can cause severe bodily injury and even death to a person. In this incident, Defendant
GregFerrero maliciously and without legal justification harmed Mr. Hither with a deadly weapon.
