RELEASE OF CLAIMS AGREEMENT
The parties hereby stipulate, agree, and enter into this Agreement–
1. Parties. This Agreement is made between liKilly, Clifford2, Hecxtro, and
Techiey.
2. Agreements. The parties agree that–
On or about July 23rd, 2022 at 11:14 PM Eastern Time, Clifford2, Hecxtro,
and Techiey (hereinafter collectively “the group”) we’re driving in Downtown
Palmer before stopping at Bloxmart in Downtown Palmer in a light blue Actilla
with license plate FJM296. liKilly was inside Bloxmart purchasing an ax for
self-defense and exited the store, finding that their vehicle was stolen.
Killy frantically got inside the light blue, asking the group for a ride to the
car dealership for fear that his vehicle might be damaged as a result of his vehicle
being stolen. After getting into the vehicle, Killy swung his ax, but as a direct
result of game mechanics, no person suffered any physical injury as a result of
swinging the ax around.
Nonetheless, Killy committed civil assault against the group, and there is no
way to prove upon a preponderance of the evidence that Killy did not commit civil
assault against the group.
The group did not commit civil assault, or trover against Killy in connection
with the incident.
Clifford2 was acting within the bounds of the law, and in self-defense, when
they shot and killed Killy for swinging his axe.
3. Dismissal. The parties agree jointly and severally to dismiss the proceedings
(i.e. the original claim and the counterclaim) in liKilly v. Clifford2, No.
RSC-CV-554 (2022).
4. Waiver of Claims. The parties agree jointly and severally to indemnify and
hold harmless each other, and to waive all future claims against one another in
connection with the incident described in the Agreements clause.
5. Waiver of Other Claims. The parties agree jointly and severally to not pursue
any civil, administrative, or other legal proceedings, or any other mechanism of
recourse against one another in connection with the incident.
6. Permission of the Court. This Agreement shall not take effect without
permission of the Court in the liKilly case (docket number RSC-CV-554).
