SUPERIOR COURT OF THE STATE OF RIDGEWAY LIKILLY, Plaintiff, v. CLIFFORD2, TECHIEY, Defendants. No. RSC-CV-554 COMPLAINT liKilly, by and through undersigned counsel, hereby brings this civil action and alleges as follows– INTRODUCTION 1. On or about July 24th, 2022, Plaintiff liKilly was at the Bloxmart in Downtown Palmer, purchasing an axe for self-defense. 2. When he came out, sat down next to a passenger door of a blue charger owned by either Defendant Clifford2, Defendant Techiey, or Hecxtro1 and had his axe out, and swung it once. 3. Clifford and Techiey then shot and killed Killy, even when he got up from the side of the car, and was backing away. 4. Killy’s conduct – i.e. swinging his axe at the vehicle while sitting down – was not a tortious or illegal act as Clifford nor Techiey or Hecxtro suffered any injury by the nature of game mechanics. JURISDICTION AND VENUE 5. This Court has jurisdiction pursuant to Article V, Section IV of the Constitution of the State of Ridgeway. 6. Venue is proper in this Court because the incident occurred in Ridgeway County. 1 Hecxtro is not named as a Defendant in this suit, but was involved in the incident enough to bring them into the facts of the case. This document does not constitute legal advice in any way, shape, or form. PARTIES 7. Plaintiff liKilly is a resident of the State of Ridgeway and principally resides within Palmer, Ridgeway. 8. Defendant Clifford2 is a resident of the State of Ridgeway and is sued in his individual capacity. 9. Defendant Techiey is a resident of the State of Ridgeway and is sued in his individual capacity. CAUSE OF ACTION (Wrongful Death) (As to Both Defendants) 10. Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 11. Defendants Clifford2 and Techiey particularly caused the death of Plaintiff liKilly without legal cause or justification by shooting Killy and fatally wounding him in the absence of any threat, whether actual or potential posed by Killy. 12. Killy was killed when Clifford and Techiey unleashed the full power of their Cline pistols and intentionally shot at Killy, and that conclusion is highly probable. PRAYER FOR RELIEF Wherefore, Plaintiff prays that the Court– a. Declare that both Defendants wrongfully caused the death of Plaintiff; b. Award Plaintiff $2,500 from both Defendants for their conduct; c. Order both Defendants to apologize to Plaintiff for their conduct; d. Order Defendants’ Ridgeway Firearms License Identification Cards (RFLIDs) to be revoked by any authorized law enforcement agency; e. Award such other, further, or different relief as may be just and proper.
