THE STATE OF RIDGEWAY SUPERIOR COURT THE STUDSPERSECOND. COMPANY, Plaintiff, v. FOOXADDICT, Defendant. Case No.: RSC-CV-510 CIVIL COMPLAINT Date Filed: 7/5/2022 COMPLAINT StudsPerSecond, by and through undersigned counsel, hereby brings this civil action and alleges as follows. INTRODUCTION 1. On June 30th, 2022, StudsPerSecond Supervisor Cethal was on-duty delivering packages to valued customers. 2. When Cethal came to the Oakland Parks area of the delivery route, he became aware of an individual who appeared to be holding a clipboard. 3. Cethal stopped delivering packages to get a closer inspection of the individual, where he could confirm that Defendant was in possession of a StudsPerSecond company-issued clipboard. JURISDICTION AND VENUE 4. The State of Ridgeway Superior Court has jurisdiction pursuant to Article IV, Section 7 of Ridgeway Constitution. 5. Venue is proper in this Court because the incident took place within Ridgeway County. PARTIES 6. Plaintiff StudsPerSecond is a private company operating within the State of Ridgeway. 7. Defendant Fooxaddict is a resident of the State of Ridgeway, employed by Plaintiff. TROVER 8. Plaintiff reasserts all allegations preceding. 9. Plaintiff maintains a company policy strictly informing employees that company-issued equipment is the property of the company, and cannot be possessed off duty or distributed to non-employees. 10. Defendant; however, possessed a company-issued clipboard while not on duty, thereby without legal justification or reason. Thus, Defendant is liable for the trover of Plaintiff’s property. PRAYER FOR RELIEF 11.Wherefore, Plaintiff prays that the Court: a. Declare that Defendant committed the act of trover against Plaintiff’s property b. Award Plaintiff $2,000 in compensatory damages c. Award Plaintiff $2,000 in punitive damages. i. The total amount of damages is assessed to cover the cost of the market value of the clipboard and the lost revenue produced by the clipboard.
