BRIEF IN OPPOSITION OF REVIEW
The Defendant in the above stated matter respectfully submits this brief in opposition to
review of petition for writ of habeas corpus.
ARGUMENT
This court may “grant or deny review of a petition based on its merits.” 1 R. Stat. § 135.
Beyond making the threadbare aversion that the “charges were falsely applied given the
circumstances,” Petition for Writ, at 2, the Petitioner fails to articulate a salient reason as to why
the arrest at question in this case was unlawful. In order for this court to grant review of a
petition, the facts alleged should support, or at the very least, suggest, that the arrest was
unlawful. Outside of the single statement, the factual allegations of the Petition do not give basis
for a petition of habeas corpus to be granted. Because this case facially lacks merit, this court
should not grant review.
