SUPERIOR COURT OF THE STATE OF RIDGEWAY DORKJACOB, Plaintiff, v. ALEXNEPTUNES, in their official capacity as a Staff Sergeant of the Ridgeway National Guard, Defendant. No. RSC-CV-474 COMPLAINT DorkJacob hereby brings this civil action and alleges as follows– INTRODUCTION 1. On or about Saturday, June 18th, 2022, Plaintiff DorkJacob was working as a delivery driver for StudsPerSecond and had three deliveries to make to the Palmer Penthouses. 2. Jacob parked their Ratero van on the side of Farley Street, and got out of the Ratero to find that Defendant AlexNeptunes was yelling happily at them, saying “what’s good”. 3. Jacob responded that they hated the Ridgeway National Guard (RNG), trying to put a speedy end to the conversation so they can get on with the important work of delivering packages in Ridgeway. For every second Jacob is off task, they are not delivering packages. A recent activity requirement in StudsPerSecond was implemented which requires Jacob to deliver thirty (30) packages every month. 4. After delivering a package and coming back outside to get another to deliver, Alex half-withdrew their government-issued M2A assault rifle, saying “hey buddy say that again”. It was clear that Alex was threatening to physically harm or bring offensive contact upon Jacob. 5. Thus, Alex assaulted Jacob and also violated RNG policy. This Court has jurisdiction pursuant to Article IV, Section 7 of the Charter of Ridgeway County. 7. Venue is proper in this Court because the incident took place within Ridgeway County. PARTIES 8. Plaintiff DorkJacob is a resident of the State of Ridgeway and principally resides at 1B Palm View, Palmer, Ridgeway. 9. Defendant AlexNeptunes is sued in their official capacity as a Staff Sergeant of the Ridgeway National Guard. FIRST CAUSE OF ACTION (Assault) 10. Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 11. Defendant intentionally and voluntarily caused Plaintiff reasonable apprehension of an immediate harmful or offensive contact when half-withdrawing their government-issued M2A assault rifle. SECOND CAUSE OF ACTION (Civil Action for Misconduct) 12. Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 13. Defendant is a public servant and failed to maintain the professional outlook of the National Guard, in violation of the National Guard Code of Conduct, OPREG 5021(5)(f), and thus committed misconduct. PRAYER FOR RELIEF Wherefore, Plaintiff prays that the Court– ON THE FIRST CAUSE OF ACTION a.
