PRAYERS FOR RELIEF Defendant avers that Plaintiff is not entitled to any relief. AFFIRMATIVE DEFENSES Defendant sets forth their affirmative defenses. FIRST AFFIRMATIVE DEFENSE (Failure to State a Claim) Plaintiff has failed to state a valid claim(s). No accusation has been made in the Complaint of wrongdoing by Defendant. SEVENTH AFFIRMATIVE DEFENSE (In Pari Delicto) The parties are equally at fault, and thus they may not bring a claim. EIGHTH AFFIRMATIVE DEFENSE (Execution of Public Duty) Defendant was executing their duty as a Deputy and properly used force to enforce the law. TENTH AFFIRMATIVE DEFENSE (Reservation) The Defense hereby reserves the right to raise any additional defenses, counterclaims, and third-party claims not asserted herein at any time of which they may become aware of after discovery or other investigation. Wherefore, the Defense prays that the Court— a. Dismiss the Complaint with prejudice for all or a combination of the affirmative defenses laid out herein; b. COUNTERCLAIM Defendant BetaTheWolfGamer, by and through undersigned counsel, hereby brings this counterclaim against Plaintiff FindKillRepeat and alleges as follows– INTRODUCTION 1. On or about May 1st, 2022, Counter-Defendant FindKillRepeat (hereinafter “FKR”) was at the Palmer Car Dealership when Counter-Plaintiff BetaTheWolfGamer, in their official capacity as a Deputy of the Ridgeway County Sheriff’s Office, was patrolling and stopped at the dealership to check on the group of people FKR was with. 2. FKR then immediately got into Beta’s face and said aggressively “what are you looking at”, posing an immediate threat of possible physical harm. JURISDICTION AND VENUE 3. This Court has jurisdiction pursuant to Article IV, Section 7 of the Charter of Ridgeway County. 4. Venue is proper in this Court because the incident took place within Ridgeway County. PARTIES 5. Counter-Plaintiff BetaTheWolfGamer is a resident of the State of Ridgeway and is a Deputy of the Ridgeway County Sheriff’s Office. 6. Counter-Defendant FindKillRepeat is a resident of the State of Ridgeway. CAUSE OF ACTION (Assault) 7. Counter-Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 8. Counter-Defendant intentionally and voluntarily caused Counter-Plaintiff reasonable apprehension of an immediate harmful or offensive contact.
