AFFIDAVIT FROM THE RESPONDENT REGARDING THE WRIT OF HABEAS CORPUS
This affidavit shall serve as the “affidavit supporting [an] arrest signed by the respondent” as required by
the Ridgeway Judiciary Act (2022)(2.5)(b)(v)(1); see also 1 R. Stat. § 135.
I, avixsz, swear under the pains and penalties of perjury that the statement and additional
information provided in this affidavit is true.
On the 15th of May 2022, I initiated my duties as a Patrol Officer within the
Palmer Police Department. I been in Palmer Police Department since March 2021 - Late
2021, then I took a long break and joined the Parks Service on February 2022 before
returning to the Palmer Police Department on Early May 2022.

On this particular occasion, I was patrolling near the RNG office within Palmer
City Limits. I heard shots fired behind the office & penthouses, so I ran there and saw the
suspect brandishing its firearms and injured. I thought the tourist batted the suspect first
and since as a veteran law enforcement, I have the feeling that this suspect caused a threat
to the tourist so I have decided to take action on the suspect. Fortunately, the suspect had
some evidence to support his "arrest" and he started the whole fight which it doesn't
justify self defense. Therefore I have decided to take action and arrested him for Second
Degree Murder. Second Degree Murder defines as "knowingly or intentionally causing a
death of an individual, serious bodily injury and commits an act clearly dangerous to
human life that causes death of an individual; or of committing or attempts to commit a
felony, other than manslaughter, and in the course of an in furtherance of the commission
or attempt, or in immediate flight from the commission or attempt, he commits or
attempts to commit an act clearly dangerous to human life." This arrest justifies because I
saw that the suspect intended to murder the victim just because he threatened the suspect.
And the suspect shot him non stop although the victim did nothing but only brandishing
his bat. He shot a few times on his dead torso even though he is dead according to the
evidence we have. The suspect knowingly or intentionally caused the death of the other
guy, and committed an act that was clearly dangerous to human life and caused the death
of that individual. And the suspect shot him non stop although the victim did nothing but

The victim ran away when the suspect shot him, from the road to the back alley of
Palmer Penthouse. He batted the suspect because he was defending himself from being
shot, but then the melee weapon does not have enough power so he ran into the lobby and
hide for a few seconds to see if the suspect stops. The victim ran out and he got murdered
by the suspect since the suspect continued to shoot at him when he was running away. He
shot the victim in a near-normal range that you would normally see during shootouts. The
suspect did not run and he just followed the victim. He didn't move when I was trying to
cuff him. (This is all accorded to the evidence that was provided to me) Me and my
fellow public sector colleague arrives at the moment the victim deceased, since both
parties had been injured, I have decided to take action and further investigate by asking
both parties to provide evidence and not trust the civilian completely. Since the suspect
sent in the evidence first, and I reviewed his first and saw he committed a crime, I have
decided to take action against him and to arrest him for SDM.
To summarize this, I had probable cause because of the video shown to him. As a
police officer and according to the department policy, we have to act if a crime is
committed. I have even more probable cause as the evidence provided by the suspect
shows him committing the crime.
