DOCKET NO. RSC-CV-367
Plaintiff
v.
xJvmma
Defendant
PETITION FOR HABEAS CORPUS
PARTIES
1. ZachCasisbeast, the plaintiff, is a citizen of the State of Ridgeway.
2. xJvmma, the defendant, is in her official capacity as an agent of the government; Lieutenant for
the Palmer Police Department.
ALLEGATIONS
1. The plaintiff, on May 08, 2022, at 9:24 PM, was pulled over by the defendant over alleged traffic
violations. Officer ArthurShelby0Jr was present on the scene to assist the Lieutenant in the traffic
stop.
2. During the conversation between the defendant and the plaintiff, the defendant was censored by
hashtags on multiple messages from the plaintiff’s perspective, making it difficult to understand
what the defendant was trying to convey.
3. The plaintiff acknowledges to the defendant that what she said was tagged out and proceeds to
threaten the plaintiff with a charge for failure to identify.
4. After threatening to charge, the defendant mentions identification as a statement and not a
question.
5. While the plaintiff was in the middle of typing to respond to the threat of charge, the defendant
pulls the plaintiff out of the car and detains him without giving the plaintiff enough time to
respond to the statements made by the defendant during the conversation.
6. The defendant claims to the plaintiff that she had asked him 5 times for his identification before
shortly driving to the police station with the plaintiff. Later, the defendant would say that she
gave the plaintiff multiple chances to identify himself.
7. The defendant later claims that the plaintiff was complaining rather than acknowledging the
tagged messages.
8. The plaintiff identifies himself to the defendant while detained in the defendant’s patrol vehicle.
9. The plaintiff is charged with § 2.05 Failure to Identify.
10. The defendant claims in her arrest report that “I asked him for ### ## # times+, he proceeded to
failure to comply with the request.” when from the perspective of the plaintiff, there was no
request for identification.
JURISDICTION
1. Article V, Section IV of the Ridgeway State Constitution grants the Court jurisdiction to
“provide writ of habeas corpus”
2. Section 2.5(a) of the Judiciary Act allows one to “at any time, over any arrest… petition the
Superior Court for a writ of habeas corpus.”
REMEDY REQUESTED
1. The plaintiff requests the expungement of the arrest mentioned.
