NOTICE OF APPEAL TO THE RIDGEWAY SUPREME COURT
Notice is given that the State of Ridgeway hereby appeals to the Ridgeway Supreme Court this
Court’s Order (May 21st, 2022; Doc. 6) granting the Defendant’s Motion to Strike Exhibits B – D (Doc.
4) and denying the State’s Response to the Motion to Strike (Doc. 5). Exhibits B and C were struck, while
D was not. Appeal is taken pursuant to § (2.3)(b)(v) of the Rid. Judiciary Act (2022) which entitles the
State to appeal to the Supreme Court in all matters that “grant[] a motion to suppress evidence, a
confession, or an admission, if jeopardy has not attached in the case and if the prosecuting attorney
certifies to the trial court that the appeal is not taken for the purpose of delay and that the evidence,
confession, or admission is of substantial importance in the case.” Exhibits B and C were struck by the
Presiding Judge, and the evidence is of “substantial importance.” We request that this Court stays its
proceedings until the disposition of this appeal. See Rid. Judiciary Act (2022)(2.3)(c).
