BACKGROUND
On the 8th of May 2022 the Ridgeway Justice Department filed an information alleging violations of 3
S.C.C § 10 on four counts and 5 S.C.C § 07 on one count. The government also entered a grand jury indictment
alleging violations of 5 R. C. C. § 07 and 5 R. C. C. § 05. The defendant appeared, however their presence was
not sustained because of their extremely improper conduct before the court, therefore the matter continued in
absentia.
JUDGMENT
The government has entirely failed to adequately admit any evidence or witness testimony relating to the
two grand jury indictments, therefore this court must acquit the defendant on both of those charges.
The government did, however, enter arguments for most other charges contained in the information. This
court is satisfied that the government has adequately proven beyond a reasonable doubt that the defendant is
guilty on counts one and two of the information, as depicted in state’s Exhibit C.
The defense argues that the defendant must be acquitted on count three, as depicted in state’s Exhibit A,
because neither the exhibit nor the accompanying witness testimony demonstrated beyond a reasonable doubt
that the defendant killed the complainant. The defense argues that it is not out of the realm of reason that an
individual outside of the scope of Exhibit A shot and killed the complainant, not the defendant, because Exhibit
A does not explicitly show the defendant shooting and killing the complainant.
In sum, this argument begs the question, is this court firmly convinced, based on a consideration of the
evidence, that the defendant is guilty of the crime charged? This court would hesitate before answering yes,
therefore the answer must be no. The evidence and testimony presented by the government does not satisfy this
court that the defendant is guilty on count three beyond a reasonable doubt. This court finds it pertinent to note
that physical evidence like Exhibit A can only allow a finding of guilt if it is supported by other evidence, such
as witness testimony. In this case, no such evidence or testimony exists to sufficiently establish guilt beyond a
reasonable doubt.
The government enters arguments in regards to count four, the alleged murder that occurred in state’s
Exhibit D. These arguments do not correspond at all with the description of events for charge four listed in the
information. The government also did not properly authenticate nor admit Exhibit D into evidence. Therefore,
this court must acquit the defendant on charge four.
In regards to charge five, the defense argues that the defendant did not know that they were using a
law-enforcement grade weapon therefore they must be acquitted. This court rejects that argument. The
defendant would have had to obtain the weapon in a number of ways that would’ve led any reasonable person to
know that the means by which they were obtaining the weapon were unlawful.
CONCLUSION
For the aforementioned stated reasons, this court finds the defendant;
