AFFIDAVIT SUPPORTING THE DEFENDANT’S MOTION FOR SUMMARY JUDGMENT
This statement shall serve as the affidavit “made on personal knowledge, [...] sets forth [...] facts as
would be admissible in evidence, and [...] affirmatively shows that the affiant is competent to testify in [these]
matters.” See Rid. R. Civ. P. (38)(d). This affidavit shall serve as the basis for the Defendant’s motion for
summary judgment.
I, Lieutenant BlackMrcow23, Area Commander of the Ridgeway State Police’s Field Operations
Bureau, swear under the pains and penalties of perjury that the statement and additional information provided in
this affidavit is true.
I was LETC class 4. I was in PPD for about a month, then I transferred to RCSO, intake 8,
06/28/2021. I served for 3-4 months on the special response team. On 10/02/2021, I transferred
from RCSO to RSP, and have been serving ever since then. I am also a Senior Instructor in
LETC currently.
On May 5th, 2022, I was on a routine patrol with a civilian ride-along, YouFoundSeal. Initially,
the Plaintiff hit me with an axe from the outside of my vehicle near Toms Takeout, and I jumped
out to try to tase and detain them. I had one suspect in custody in the back of my vehicle when he
hit me. They kept jumping in and out of the vehicle, from passenger seat to passenger seat, until
they got in the driver's seat and managed to drive away. I was going to let my suspect go since I
wanted to catch the Plaintiff because my current suspect's offense wasn't as serious. When I
pulled over, the Plaintiff parked beside me, hopped out, and attempted to beat me with an axe,
which was essentially a repeat of what happened the previous time. They moved from seat to
seat until they were able to flee.
At this point, I issued a BOLO, or Be On Lookout, and began canvassing the area for any
potential witnesses who might have observed where the Plaintiff had gone. When I saw them the
third/fourth time or the time that the defendant was reported for, I called in a pursuit and began
chasing the suspect. After disabling the vehicle, the Plaintiff kept swapping seats, and in order to
keep him out of the driver's seat, my ride-along assisted me by sitting in the Plaintiff's vehicle’s
driver seat. People often enter the driver’s seat to evade police officers, and it appears that is
exactly what the Plaintiff intended to do here. Shortly after, I was able to tase the Plaintiff and
arrest them. He was simply assisting me in apprehending a suspect and preventing them from
evading.
