DOCKET NO. RSC-CV-315
Plaintiff
v.
BRENTABOY
Defendant
CIVIL COMPLAINT
Plaintiff BetaTheWolfGamer brings this civil action against Defendant Brentaboy, as a result of the facts
that follow.
FACTS ALLEGED
Plaintiff alleges that:
a. On April 29th, 2022, the defendant and plaintiff were present in the City of Sterling.
b. The plaintiff observed the defendant exiting their vehicle and firing at a civilian using a pistol,
without provocation.
c. At the time of the incident, the plaintiff was an off-duty employee of the Ridgeway County
Sheriff’s Office and armed with a department-issued pistol. Acting in defense of others, the
plaintiff began firing at the defendant.
d. The defendant drove away from the area upon being shot at, and the plaintiff entered the nearby
Ridgeway County Sheriff’s Office substation.
e. A short time afterwards, the defendant drove back to the area of the incident involving the
shooting of the civilian.
f. Upon the plaintiff exiting the Sheriff’s Office substation, the defendant exited their vehicle and
began shooting at the plaintiff with a pistol. Some shots, including the first shot, missed the
plaintiff. This resulted in audible ricochets which caused the plaintiff to apprehend imminent
harmful contact (i.e. the alleged assault). Many shots did strike the plaintiff (i.e. the alleged
battery).
g. There was no provocation at this time that led to the defendant’s shooting of the plaintiff, and the
plaintiff did not act aggressively or in a threatening manner toward the defendant when the
plaintiff was shot at.
h. The plaintiff returned fire with his pistol, but was critically injured as a result of being hit by the
defendant’s gunfire.
i. The defendant, also injured, fled the venue of the shooting in their vehicle about 20 seconds after
his first shots were fired at the plaintiff.
JURISDICTION
This Court has jurisdiction over this civil action because the torts are alleged to have been committed in
the City of Sterling, which is a part of the territorial jurisdiction of the Superior Court of Ridgeway.
TORTS
The defendant is alleged to have committed the following tortious acts:
a. One count of battery, defined in 1 R. Stat. § 202
b. One count of assault, defined in 1 R. Stat. § 203
RELIEF
The plaintiff asks the Court to order that monetary damages be paid:
a. for the battery, $2,500;
b. for the assault, $1,500;
for monetary damages totalling $4,000.
