CLAIM NO. RSC-AD-266
ORDER ON ADMINISTRATIVE CLAIM
WHEREAS, the Administrative Procedure Act § 1.8(a)(v) prevents punishments that fail to
account for “mitigating factors, circumstances, or liabilities.”
WHEREAS, the petitioner reasonably exercised his powers as a law enforcement officer and
made an appropriate judgment to label a particular individual as a threat to life provided the
circumstances of the situation in which he was involved, including a sound determination of the
threat exhibited by a suspect.
WHEREAS, the suspect shot by the petitioner failed to indicate his affiliation with a particular
criminal organization, with his involvement in such being a reason for the petitioner’s decision to
utilize lethal force against him.
NOW THEREFORE, the claim is SUSTAINED and the department strike issued against the
petitioner in 2-22-0016-C-RSP is ordered to be removed.
