RULING ON MOTION TO STRIKE

BACKGROUND
On the 7th of June 2022, the counsel for the defense made a motion to strike exhibit B alleging that the
evidence is 1) Irrelevant 2) Even if irrelevant heavily prejudicial and 3) Would violate the defendants right to
due process if used.
JUDGEMENT
The court finds that the evidence has probative value, as it could provide a motive for the defendants
actions and is therefore relevant to the case. The prosecution must properly connect the evidence to the crime to
paint a full picture and excluding the evidence before the trial would not allow the court to see the full picture.
The evidence presented is not prejudicial as it is entirely possible that the group was involved in the
events presented before the court, and it is entirely up to the prosecution to prove that at trial. The evidence
could not taint the court. Unless there is a direct connection made between the events presented before the court,
the court could not possibly take the evidence into consideration when ruling on the case. The court does not
find that this evidence was presented to invoke prejudice as it does not invoke any more emotion then evidence
previously presented before the court, nor does it make any unfair statements about the defendant's character.
Mens rea is an important fact of the case and this evidence has a large probative value in potentially proving
mens rea.
The defense stated in their motion: "This freedom extends to the association with criminal syndicates so
long that the accused did not participate in any unlawful activities perpetrated by the organization." The court
agrees with that statement. The prosecution must prove that the events were connected to this criminal
organization and striking the evidence before the opportunity has been given to them would be unfair to the
prosecution.
CONCLUSION
The court will not be striking evidence B. Therefore the motion is DENIED
SO ORDERED, ADJUDGED AND DECREED.
