RESPONSE TO MOTION TO DISMISS

RESPONSE TO ARGUMENTS
1. “Plaintiff was not assaulted” - We contest this point by disputing that it is premature to
adjudicate the merits of this case in any way, and that this is a dispute of which can be
argued, and settled at trial. Additionally, according to 5. R. Stat. § 203, in order to prove
“Assault”, you have to prove, “[A] individual who intentionally or voluntarily caused
reasonable apprehension of an immediate harmful or offensive contact”, meaning that
in order to prove assault you don’t have to prove actual physical contact, but the
apprehension of such from the Defendant against the Plaintiff.
2. “No Battery Involved” - We similarly contest this point by disputing that it is premature
to adjudicate the merits of this case in any way, and that this is a dispute of which can be
argued, and settled at trial. Consequently, the Plaintiff would like to argue that the alleged
actions of the Defendant subsequently caused physical harm to be brought upon the
Defendant, making him culpable to physical harm and contact brought by his actions
against the Plaintiff, and giving the Plaintiff standing to sue for the tort Battery (5 R. Stat.
§ 202).
3. For those reasons, we ask the Court to reject the Defendant's Motion to dismiss without
prejudice.
