Paulcar1, proceeding with counsel, hereby submits a motion to dismiss without prejudice.
ARGUMENTS
PLAINTIFF WAS NOT ASSAULTED
The plaintiff was not assaulted in any way in this situation. The evidence (found in the video sent
by the plaintiff’s attorney) clearly shows that the plaintiff was not assaulted by the defendant in
any way during this scenario, however, shot by others.
NO BATTERY INVOLVED
5 R. Stat. § 202 clearly states "Any individual who brings unconsented harmful or offensive
contact against another person is battery and shall be liable for punitive damages up to $2,500"
Judging by the evidence, there was no physical contact shown.
