DISMISSAL ORDER
SUMMARY JUDGMENT
Plaintiff initiated a civil suit against Defendant on July 3rd, 2021. A summons was issued
in the Courts name for the appearance of the Defendant on July 4th, 2021, ordering that he appear
within forty-eight hours. Defendant, having properly been served, has failed to appear. Thus, the
Court must look at the facts presented and determine if there is no reasonable dispute, and that no
person could bring about a reasonable dispute. Rid. R. Civ. P. 16(d). The facts in the case show
Defendant using a weapon to kill Plaintiff. Defendant, based on facts alone, caused the wrongful
death of Plaintiff.
CONCLUSION
Summary judgment is granted for both tortious claims. Defendant is ordered to
compensate Plaintiff with $800 for the claim of assault, and $2,000 for the claim of wrongful
death by 7/11/2021 at 6:00pm Eastern, or a warrant will be issued for their arrest.
