5. NATURE OF ACTION (Administrative): Review of the policies, rules, and conduct of a
civil service agency in connection with the denial of an application for appointment to the
civil service, and the unlawful, biased, retaliatory, and unreasoned conduct of its officers
in connection therewith.
6. BASIS OF JURISDICTION:
- 4 R. Stat. Section 141.007 (original jurisdiction over matters involving the
internal policy or rules of a civil service agency) [PRIMARY];
- 4 R. Stat. Section 141.101 and Section 141.006 (administrative claim that an
adverse employment action was arbitrary or without due observance of state
statute) [ALTERNATIVE];
- 4 R. Stat. Section 123.501(g)-(h) (statutory right of all persons to seek court
review of prejudicial or harmful employment practices and to petition the courts);
- 4 R. Stat. Sections 141.010 and 141.011 (equitable and declaratory relief).
7. RELATED PROCEEDINGS:
- Office of the State Auditor, Case No. PC-0019-0526 (tipline complaint; dismissed
without merits findings; evidence found factually credible).
- Ridgeway Department of Transportation alternate-account determination
concerning Plaintiff (initial determination reversed to a pass on identical
evidence).
8. RELIEF SOUGHT: Declaratory and injunctive relief only. NO MONETARY
DAMAGES ARE SOUGHT.
9. JURY DEMAND: None. This matter is to be heard and decided by an Administrative
Court Judge pursuant to 4 R. Stat. Section 141.101(a).
10. AMOUNT IN CONTROVERSY: Not applicable. No monetary damages are sought.
11. REQUEST FOR EXPEDITED TREATMENT: Plaintiff requests that this matter be set
for administrative hearing within seventy-two (72) hours of filing pursuant to 4 R. Stat.
Section 141.108.
