MOTION TO SET ASIDE DEFAULT ENTRY
Pursuant to Ridgeway Rules of Civil Procedure 37(c) and Rule 42(b)(1), Defendant
respectfully moves this Court to set aside the entry of default entered against them in this action.
In support of this motion, Defendant states as follows:
GOOD CAUSE AND EXCUSABLE NEGLECT EXIST TO SET ASIDE THE DEFAULT
Under Rule 37(c), the court may set aside an entry of default "for good cause shown".
Furthermore, Rule 42(b)(1) allows for relief from a proceeding due to "mistake, inadvertence,
surprise, or excusable neglect".
While Rule 4(d)(1) permits service of process to be conducted through direct messaging,
the direct message containing the summons and complaint in this matter was automatically
filtered by the platform into the Defendant's "spam" section. Because the message was hidden by
the platform's automated filters, the Defendant had no actual knowledge of the pending lawsuit
until he was notified by another individual about it. The Defendant's failure to respond was not
willful or meant to delay, but rather the result of genuine inadvertence and excusable neglect.
DEFENDANT POSSESSES A MERITORIOUS DEFENSE
Setting aside the default serves the interest of substantial justice because the Plaintiff’s
complaint is legally insufficient. If permitted to respond, the Defendant will move to dismiss
under Rule 12(a)(5) for failure to state a claim upon which relief can be granted.
Rule 8(a) requires a pleading to contain "a short and plain statement of the claim showing
that the pleader is entitled to relief". The Plaintiff’s complaint names the Defendant in their
individual capacity as a State Trooper but is entirely devoid of factual allegations explaining why
the Defendant is individually liable. Because the complaint asserts a legal conclusion without
providing the required factual basis to show entitlement to relief, the Defendant has a strong and
meritorious defense requiring dismissal.

PRAYER FOR RELIEF
For the foregoing reasons, the Defendant respectfully requests that this Court find good
cause, set aside the entry of default, and grant the Defendant leave to file a responsive pleading
within a timeline set by the Court.
