RESPONSE TO PETITION
dev_Typ, N_athannn, by and through the Department of Justice, answers the Habeas Corpus
petition as follows:
I. Introduction
A. The Department of Justice, on behalf of the State of Ridgeway, submits this response in
support of Petitioner’s request for habeas relief.
II. Factual Basis
A. Petitioner was taken into custody following a traffic stop and subsequently booked
B. At the time of the arrest, we, the State, confirm:
a. A duty court was in session conducting probable cause hearings;
b. Petitioner requested said hearing;
c. Petitioner was instead transported, processed, and detained without judicial
review, a violation of his rights;
III. Petitioner’s Rights Were Indeed Violated
A. 1 R. Stat § 2807 gives detainees the right to be heard by a judge via a probable cause
hearing when one is active and when law enforcement was notified
B. The State confirms as a matter of fact that the Trooper had notice of such a hearing

IV. HABEAS SHOULD BE GRANTED
A. The purpose of habeas corpus is to remedy unlawful restraint.
B. The issue before the Court is not whether the underlying charge may ultimately be
sustained, but whether the deprivation of liberty complied with governing law.
C. Where required procedural safeguards are not followed, continued detention cannot be
upheld.
V. SCOPE
A. The Department of Justice emphasizes that granting habeas relief (a) does not
constitute a determination on the merits of any underlying offense and (b) does
not prevent lawful re-initiation of charges through proper procedures, but instead
corrects a procedural defect in the detention.
WHEREFORE, The Honorable dev_Typ, by and through the Department of Justice as
representing Trooper N_athannn prays this Honorable Court:
A. Grant the Petition for Writ of Habeas Corpus;
B. Grant such other relief as the Court deems just and proper.
