Defendant NPCWAR, by and through undersigned counsel, hereby moves this Court on
an emergency basis to stay the currently ongoing trial pending the resolution of Defendant’s
Motion to Dismiss on the grounds that the Motion to Dismiss raises potentially dispositive
grounds that should be resolved before continuation of the trial, and that the trial as it continues
renders the Rule 13(d)(2) filing right illusory.
