MOTION TO SEVER
dev_Typ, the Palmer Police Department, by and through the Department of Justice, respectfully
moves this Court to sever the claims presented in this Administrative Complaint and states as
follows:
I. Introduction
The petitioner is challenging two separate disciplinary matters. Specifically, he is
challenging conduct violation cases: PSD-26-002 and PSD-26-003. These matters are distinct in
nature as they arise from different incidents, involve separate factual records, and require
independent legal analysis.
II. Argument
To ensure administrative fairness, courts generally require that unrelated claims be
adjudicated separately.
In this case, the aforementioned claims: (1) involve different conduct, (2) rely on
different evidence and witnesses, and (3) present distinct legal questions. The petitioner himself
acknowledges that these cases are distinctly different when he separates them in his complaint,
stating that one case violated the law when a legal conclusion was drawn. Combining these two
cases into one would be a horrendous mistake and risks prejudice and improper blending of legal
standards.

CONCLUSION
WHEREFORE, The Honorable dev_Typ, by and through the Department of Justice as
representing the PALMER POLICE DEPARTMENT prays this Honorable Court:
A. Sever the claims relating to PSD-26-002 and PSD-26-003 into separate
proceedings; and
B. Grant such other relief as the Court deems just and proper.
