ORDER
Petitioner respectfully moves for an order granting expedited summary judgment in his
favor. This case raises a straightforward constitutional question and presents no disputed material
facts, making summary judgment proper.
The constitutional questions of this case have already been answered by this Court. See
JamesGardai v. Ridgeway County Sheriff’s Office, RSC-CV-5477 (Rid. Adm. Ct. 2026) (holding
that “public employees possess a constitutionally protected property interest in their
employment.”). The government is collaterally estopped from arguing against a property interest.
Because the facts are clear, the injury is ongoing, and this issue has been authoritatively
resolved by this Court, Petitioner respectfully requests that the Court treat this motion as one for
expedited summary judgment in lieu of preliminary relief.
