NOTICE OF IMPROPER
PROSECUTORIAL CONTACT

NOTICE
I write to bring to the Court’s attention a matter of procedural concern that has arisen in
the above-captioned case prior to arraignment.
On or about April 18th, the prosecuting attorney, Detachment Result, communicated
directly with my client, NPCWAR, without my knowledge or consent, and without authorization
from this Court for my client to appear in propria persona. The substance of that communication
concerned the disposition of the pending charges, specifically a proposal to substitute the
brandishing charge under R.C.C. § 5.04 for an unrelated charge designated as ‘FDM’, which has
no factual basis in the investigation report or the Statement of Probable Cause filed in this matter.
This conduct appears to constitute a violation of Rule 4.2 of the Ridgeway Rules of
Professional Conduct,which prohibits an attorney from communicating directly with a
represented person about the subject of representation without consent of opposing counsel, as
well as Rule 3.8(c), which prohibits a prosecutor from seeking to obtain from an accused a
waiver of important pretrial rights without tribunal approval of self-representation.
I respectfully request that the Court:
(1) Take judicial notice of the communication and make a finding as to whether it constitutes
improper contact;
(2) Order that all future communications regarding this matter be directed exclusively
through defense counsel; and
(3) Consider whether sanctions or other remedial measures are appropriate in light of the
conduct described.
A copy of the communication in question is attached hereto as Exhibit A for the Court’s
reference. I have also filed a complaint with the Ridgeway State Bar concurrent with this notice.
I remain available to address any questions the Court may have at the earliest convenient
opportunity.
