THE STATE OF RIDGEWAY, to the Honorable the Judges of the Superior Court of
Ridgeway, G REETING:
WHEREAS, in the Superior Court of Ridgeway, in a cause between STATE OF
RIDGEWAY; and RIDGEWAY COUNTY SHERIFF’S OFFICE, Plaintiffs, and
JAMESGARDAI, Probationary Deputy in the Ridgeway County Sheri�’s Office, in his
individual capacity, Defendant, Civil Action No. RSC–CV–8708, a motion for recusal was
filed and denied;
AND WHEREAS, the said cause was brought before this Court by Petition for a Writ of
Mandamus filed by the said Defendant, JamesGardai, as Petitioner in this Court;
AND WHEREAS, in the present Term of this Court, the said cause came on to be
considered upon the Petition and the record;
NOW, THEREFORE, it is ORDERED and ADJUDGED that the Petition for a Writ of
Mandamus be, and hereby is, GRANTED.
IT IS FURTHER ORDERED that Judge Arthur Chen is recused from presiding over the
aforesaid Superior Court cause, and that further proceedings be conducted before a
different judge, in conformity with the judgment and opinion of this Court.
YOU, THEREFORE, are hereby commanded that such further proceedings be had in said
cause as shall be consistent with the judgment and opinion of this Court, and according to
right and justice and the Constitution and laws of the State of Ridgeway.
ISSUED AS THE MANDATE of this Court this twenty-eighth day of February, two
thousand and twenty-six.
