CIVIL COMPLAINT FOR OFFICIAL MISCONDUCT AND DEPRIVATION OF RIGHTS
1. Plaintiff, by and through its undersigned counsel, brings this action for damages against
Defendants, troidal and mp5sopmods, and alleges as follows
JURISDICTION AND VENUE
2. This court has original jurisdiction over “all civil and criminal cases or controversies.” Rid. Const.
art. 5, § 4.
3. Venue is proper in this Court as the events giving rise to this Complaint occurred within the State
of Ridgeway.
PARTIES
4. Plaintiff is an individual and a citizen and resident of the State of Ridgeway.
5. Defendant troidal is, upon information and belief, a member of the Ridgeway National Guard. At
all times relevant, he was acting under color of law. He is sued in his official capacity.
6. Defendant mp5sopmods is, upon information and belief, a member of the Ridgeway National
Guard. At all times relevant, he was acting under color of law. He is sued in his official capacity.
FACTUAL ALLEGATIONS
7. On or about August 8, 2025, the decedent, richardm, was operating his vehicle within a Military
Exclusion Zone (MEZ).

8. While Plaintiff was driving, an unnamed National Guardsman negligently and unexpectedly
walked directly into the Plaintiff's lane of travel, creating a sudden emergency and leaving the
Plaintiff with insufficient time to avoid a collision.
9. Immediately upon realizing he had struck the guardsman, Plaintiff acted responsibly and
brought his vehicle to a complete and immediate stop on the roadway, thereby surrendering to
the authority of any and all military personnel present.
10. At this moment, Plaintiff was stationary, inside his vehicle, and posed no threat whatsoever to
the Defendants or any other person.
11. Despite the Plaintiff's vehicle being completely stopped, Defendants troidal and mp5sopmods,
who were present at the scene, made the unconscionable decision to use deadly force.
12. Both Defendants raised their service rifles and began unloading their weapons into the Plaintiff's
parked vehicle.
13. The Defendants fired multiple volleys, with sufficient time between shots to assess the situation
and cease their unlawful attack. They nevertheless continued to fire with the clear and malicious
intent to destroy the vehicle and kill its occupant.
14. The sustained gunfire from the Defendants caused the Plaintiff's vehicle to catch fire and
ultimately explode, killing richardm.
15. This use of overwhelming and continuous deadly force against a surrendered, stationary
individual was grossly disproportionate, malicious, and served no legitimate law enforcement or
military purpose. It was an extrajudicial execution.
FIRST CAUSE OF ACTION (Official Misconduct) (Against Both Defendants)
16. Plaintiff realleges and incorporates by reference the preceding paragraphs.
17. Defendants are public servants. Their acts of using sustained, deadly force against a surrendered
individual in a stationary vehicle constitute a malicious and unauthorized exercise of their official
functions. A reasonable person with their training would know such acts are a flagrant violation

of the law and established use-of-force policies. This constitutes official misconduct pursuant to 1
R. Stat. § 3114.
SECOND CAUSE OF ACTION (Deprivation of Rights) (Against Both Defendants)
18. Plaintiff realleges and incorporates by reference the preceding paragraphs.
19. Both Defendants, acting under color of law, caused richardm to be subjected to the deprivation of
his most fundamental rights secured by the Constitution, including the right to life and the right
to be free from unreasonable seizure and excessive force, making them liable under 1 R. Stat. §
3115.
WHEREFORE, Plaintiff, respectfully requests that this Court enter judgment in its favor and
against Defendants as follows:
a. Awarding compensatory damages against both Defendants, in their official capacities, for the
wrongful death of richardm and the destruction of his property, to be satisfied by the
government as required by 1 R. Stat. § 3114(iii);
b. Awarding punitive damages against Defendant troidal personally for his malicious and
depraved actions, in an amount up to the statutory maximum allowed by law;
c. Awarding punitive damages against Defendant mp5sopmods personally for his malicious and
depraved actions, in an amount up to the statutory maximum allowed by law;
d. Awarding the costs of this action; and
e. Granting any and all other relief that this Court deems just and proper.
