MOTION FOR DELINQUENCY

INTRODUCTION
Plaintiff respectfully applies for the issuance of a Writ of Execution pursuant to the
judgement entered on July 25th, 2025, in the above-captioned matter, and in support
thereof states the following:
1. The Court entered a default judgement in favor of the Plaintiff against
Defendant in the amount of $5,000.
2. The Defendant was ordered to satisfy the judgement within seven (7) days
of entry. The deadline for payment was August 1st, 2025.
3. To date, the Defendant has failed to make any payment toward the
judgement and has expressed clear refusal to comply.
4. On August 2nd, 2025, Plaintiff filed a Motion for Delinquency.
5. Should the Motion be granted, Plaintiff would seek enforcement of the
judgement through the issuance of a Writ of Execution authorizing the
seizure of the Defendant’s non-exempt assets and property.
WHEREFORE, Plaintiff respectfully requests that this Court:
- Issue of Writ of Execution authorizing the enforcement authority to levy
upon the Defendant’s property to satisfy the judgement; and
- Grant such further relief as may be just and proper.
