MOTION FOR DELINQUENCY

INTRODUCTION
Pursuant to 1. R. Stat. § 3302, Plaintiff hereby moves this Court for an order
finding Defendant delinquent in satisfying the judgement previously entered in this
matter, and in support thereof states the following:
1. On July 25th, 2025, this Court entered a default judgement in favor of the
Plaintiff against the Defendant in the amount of $5,000.
2. The Court’s order required the Defendant to satisfy the judgement within
seven (7) days of entry, making the deadline for payment August 1st, 2025.
3. As of the date of this filing, the Defendant has failed to make any payments
toward the judgement and has not sought any relief from enforcement of
the judgement.
4. Further, the Defendant has repeatedly affirmed their refusal to comply with
the Court’s order and has made clear their intention not to pay. In-fact, they
have openly admitted to not paying, and have asked the Court for a writ of
execution.
5. Defendant’s failure to satisfy the judgement constitutes a delinquency under
1 R. Stat. § 3301.
WHEREFORE, Plaintiff respectfully requests that this Court:
- Enter an order finding Defendant delinquent in satisfaction of the
judgement; and
- Grant leave for Plaintiff to file an Application for Writ of Execution or take
further enforcement action as appropriate.
