COMPLAINT
FACTUAL ALLEGATIONS
1. On July 14, 2025, Plaintiff filed a Civil Complaint against the Defendant for assault,
battery, and wrongful death.
2. A copy of the Summons and Complaint was duly served upon the Defendant, and
proof of service was filed with this Court.
3. The time for Defendant to file an Answer or otherwise respond to the Complaint has
expired. To date, Defendant has failed to file an answer, motion, or any other
responsive pleading.
4. Because Defendant has failed to appear and defend this action, she has admitted to
the factual allegations in the Complaint. Plaintiff is therefore entitled to a default
judgment as a matter of law.
CALCULATION OF DAMAGES
Plaintiff requests that judgment be entered against the Defendant in the following
amounts, as pleaded in the original Complaint:
A. Compensatory Damages
• Wrongful Death: This includes loss of life, pain and suffering. A reasonable
valuation for the complete and permanent loss of life is $5000.
Total Compensatory Damages: $5000
B. Punitive Damages
The purpose of punitive damages is to punish the defendant for her malicious
conduct and deter similar conduct in the future. The Complaint seeks the maximum
punitive damages allowed for each tort.
• For the act of Assault:
o Statutory Maximum Punitive Damages: $3,500.00
• For the act of Battery:
o Statutory Maximum Punitive Damages: $4,500.00
• For the act of Wrongful Death:
o Statutory Maximum Punitive Damages: $5,000.00
Total Punitive Damages: $13,000.00
C. Total Judgment Requested
• Total Compensatory Damages: $5,000.00
• Total Punitive Damages: $13,000.00
• TOTAL JUDGMENT: $19,000.00
PRAYER FOR RELIEF
WHEREFORE, Plaintiff, 0xSyns, respectfully requests that this Court:
a. Enter a default judgment against Defendant xStephanieisabaddiex;
b. Award Plaintiff compensatory damages in the amount of $5,000.00;
c. Award Plaintiff punitive damages in the amount of $13,000.00;
