CONSENT MOTION TO CONSTRUE
Defendant CarnageCulture, by and through the undersigned counsel,
respectfully moves the court to construe the pending motion for a temporary
restraining order as a motion for a preliminary injunction, and states as follows in
support:
1. Construing the motion as one for a preliminary injunction will
promote judicial economy. The motion is no longer ex parte, and both parties are
now represented and able to fully brief their positions. Treating the motion as one
for a preliminary injunction will avoid duplicative briefing—such as requiring
separate rounds of briefing and argument if a temporary restraining order were first
granted and later followed by a motion for a preliminary injunction.
2. Plaintiff consents to construing the motion for a temporary restraining
order as a motion for a preliminary injunction.
