Disposition
Judgment of the Superior Court, located at RSC-CV-510, vacated and remanded. Hand, J., delivered the opinion of the Court, in which Burger, C. J., Gorsuch, J., Jackson, J., Powell, J., and Thomas, J., Powell, J., filed an opinion concurring in the judgment.
Unanimous Court
Summary
Consolidated certiorari from two Superior Court suits by shipping company StudsPerSecond over dispenser-produced clipboards. The Court held that dispensed items are not of "unsubstantiable" value (so dismissal in BPD_Edgar for lack of value/standing/mootness was error), that valuation methodology is left to trial-court discretion, and that in Fooxaddict a default judgment of $10 against a $4,000 demand violated Rid. R. Civ. P. 36's rule that default judgments not differ in kind from that prayed for; refusal to admit the late amended complaint was within discretion under Rid. R. Civ. P. 13.
